Uniland Development Acknowledgement and Agreement
I understand that this Acknowledgement and Agreement applies to this application and to the application(s) of all applicants. I clearly understand that a background check fee will be collected by landlord and that all occupants, including myself, are subject to approval and acceptance by landlord in its sole discretion. The background check fee shall be retained by the landlord as the agreed compensation for credit/financial and criminal background checks and landlord shall have no further obligation to me. In no event is the background check fee refundable to me.
I hereby certify that I am the person making this application and that all information contained herein is true and correct in every particular. I understand that while processing this application, an investigation report may be made whereby information may be obtained as to character, general reputation, personal characteristics, and mode of living. I have a right to make a written request for a complete and accurate disclosure to the nature and scope of any such investigative report.
I hereby consent to allow landlord, itself or through its designated agents or employees, to obtain a consumer report and criminal record information on me and to obtain and verify my credit and employment information for the purpose of determining whether to lease an apartment or house to me. I also agree and understand that landlord and its agents or employees may obtain additional consumer reports and criminal reports on me in the future to update or review my account. Upon my request, the landlord will inform me whether consumer reports or criminal record reports were requested and the names and addresses of any consumer reporting agency that provides such reports. The landlord will provide to me notice of any adverse action.
I understand that an incomplete application causes a delay in processing and may result in denial of tenancy. I understand that a lease will be issued only upon approval and that all payments will be made in accordance with the executed lease. If the landlord is unable to deliver possession of proposed apartment on the agreed date for any reason, including holdover of a prior resident, then the landlord shall not be liable as a result. I also understand that the landlord is under no obligation to deliver possession of another apartment but that Landlord will make every attempt to assign another similar apartment unit. I understand that, if after thirty (30) days of the agreed date of possession, landlord does not have an available unit, landlord may deny the application, even if previously approved, and refund any charges paid with the exception of the application fee(s).
I understand that I am applying for tenancy in a smoke-free community and that smoking is prohibited in all units, buildings, and grounds throughout the community. Completion and submittal of this application is my agreement and acknowledgement that, if this application is approved and accepted, that all occupants, including myself, as well as guests, visitors, and the like will comply with the smoke-free policy.
I hereby waive any claim for damages by reason of non-acceptance of this application, which the landlord or its agent may reject without stating reasons for so doing. It is further agreed that if any information herein is false, the lease made on the strength of this application may, at the option of the landlord, be terminated at any time.
By my acceptance and submittal, I certify that I have read and understand the terms and conditions of this application.
